Esmark, Inc. petitions for review of an order of the National Labor Relations Board (the "NLRB" or "Board") finding Esmark guilty of violations of sections 8(a)(3) and 8(a)(5) of the National Labor Relations Act (the "NLRA"), 29 U.S.C. section 158(a)(3), (a)(5). The Boards order is reported at 289 NLRB No. 51 (June 29, 1988). We grant Esmarks petition for review and remand the case to the Board for further proceedings.
